This cancellation policy forms an integral part of the general terms and applies to all reservations made via Lux Living. By confirming a reservation, the guest accepts the following conditions.
Pursuant to Article VI.53, 12° of the Belgian Code of Economic Law, the statutory right of withdrawal does not apply to tourist rentals with a fixed date or period. The guest expressly acknowledges this when confirming the reservation.
Unless the flexible cancellation option is expressly selected at the time of booking, the non-flexible rate applies. In that case:
At the time of booking, the guest may choose the flexible rate, subject to payment of a surcharge on the base rate. This rate provides the following benefits:
The selected rate option is clearly stated in the booking confirmation and cannot be changed after confirmation.
4.1. In exceptional cases where Lux Living cannot deliver the stay due to force majeure (as defined in Article 14 of the general terms — including fire, water damage, severe technical defects, unavailability of the property, or governmental measures), the guest may choose between:
4.2. Lux Living cannot in that case be held liable for additional costs such as transport, alternative accommodation, loss of holiday time, or any other indirect damage.
5.1. Personal circumstances of the guest (illness, accident, bereavement, separation, change in work circumstances, etc.) are expressly not accepted as grounds for free cancellation or refund, regardless of the rate chosen.
5.2. Guests are strongly advised to take out cancellation insurance that covers such situations.
In certain circumstances — for example, by commercial agreement outside this policy — Lux Living may grant a travel credit instead of a refund.
Requests to change booking dates, the number of guests, or the property will be accommodated where possible, subject to availability and approval by Lux Living. Any price differences remain payable by the guest. Changes that effectively amount to a cancellation and rebooking are treated as a cancellation.
A guest who does not show up (no-show) or departs early is not entitled to any refund, regardless of the rate chosen.
Cancellations must be sent in writing to info@luxliving.be, stating the booking number and the requested action. The date of receipt of the message by Lux Living counts as the date of cancellation. Lux Living will confirm any cancellation by e-mail.
This cancellation policy is subject to Belgian law and to the general terms of Lux Living. Any disputes fall under the jurisdiction of the courts of the West Flanders judicial district, division of Veurne.
Lux Living reserves the right to amend this cancellation policy at any time. Changes do not apply to reservations already confirmed.
