TERMS AND CONDITIONS

LUX LIVING offers fully equipped luxury homes for rent on the Belgian coast with a quality service. These general terms and conditions of sale (hereinafter the "GTC") apply to any Reservation made on an individual basis by a natural person aged at least 18 years old (hereinafter the "Customer") on the website www.luxliving.be, for one or more Accommodations operated under the LUX LIVING brand. The Customer is kindly requested to consult the internal regulations of the Accommodation(s) chosen by him in order to find out the conditions of stay of each Accommodation (hereinafter the "Household Regulations"), which will be sent to him when the relevant Reservation is concluded.

By using the Site, the Customer acknowledges that he/she has full legal capacity to make commitments under these GTC and warrants the truthfulness and accuracy of the information he/she provides. The Customer chooses from the offers on the Site that are valid at the time of his consultation. The Customer's agreement with the GTC takes effect at the moment the Reservation becomes final, so that the Customer acknowledges having taken note of the GTC and has accepted them without reservation; no Reservation is possible without this acceptance. Unless expressly stated in writing, no special terms and conditions supersede the GTC, which supersede all prior written or oral agreements. The GTC may be modified/added at any time without prior notice, with the new provisions taking effect as soon as they are published on the Site or any other booking platform. The Customer must therefore consult them regularly in order to be informed of any changes that may affect him/her. If one or more of the provisions in the GTC should for any reason cease to be valid or applicable, this will not affect the validity, legality and legal enforceability of the remaining provisions. The Customer has the option to save and edit the T&C using the standard functions of his/her browser or computer.

 

The services offered by Lux Living are exclusively reserved for adult persons over 18 years of age. By accepting these GTC, the Customer therefore acknowledges that he is of age. Anyone under the age of 18 is prohibited from registering for the Services. In the case of a Reservation made by a person under the age of 18, Lux Living reserves the right to cancel the Reservation, without prior notice or any compensation payable to the person who made the Reservation.

 

ARTICLE 1 - DEFINITIONS

Capitalized terms defined in this paragraph, whether used in the singular or plural in the T&C, have the following meaning:

"Client(s)": natural persons, non-commercial, who are at least 18 years old on the date of the Reservation and who are capable of making individual reservations (as opposed to group reservations) for personal use on the Site;

 

"Terms and Conditions" or "GTC" refers to this document;

 

"Party or Parties" means Lux Living and the Customer individually in the singular and together in the plural;

 

"Accommodations" means all apartments for which a Customer may make a reservation through the Site;

 

"Reservation" means the order and payment of an Accommodation by the Customer. Once booked, the Accommodation cannot be assigned to other customers for the same period. It is hereby stipulated that the Customer cannot simultaneously book more than 5 Apartments or for more than 30 people for the same period. In that case, the Reservation will be qualified as a Group Reservation. Consequently, in case of a Reservation for a larger number of persons or Apartments, the Customer must send an e-mail to the address stated on the Contact page. Likewise, the Customer cannot reserve an Accommodation for a period of more than one month. Therefore, in case of a Reservation for a longer period, the Customer must send an email to the address indicated on the Contact page;

  • "Site" means the website www.luxliving.be operated by Lux Living accessible on computer, tablet or mobile device, through which the Customer can search, consult and make Reservations;

  •  

  • "Reservation Platform" means the channel accessible on computer, tablet, mobile device, through which the Customer can search, consult and reserve Accommodation, other than the Website;

  •  

  • "Basic Rate" means the amount paid by the Customer at the time of booking the Accommodation and includes all nights for all occupants and the services described in Article 4 as being included in the Base Rate.

ARTICLE 2 - PURPOSE

 

The GTC define the rights and obligations of everyone when booking an accommodation. The GTC only apply to individual Reservations of up to one month made with Lux Living. In the case of a Reservation for one or more Accommodations for a period of more than one month, the Customer must send an email to the address indicated on the Contact page to find out the general terms and conditions of sale applicable.

In the case of a Group Booking, i.e. a Booking for more than 30 people or 5 Apartments, the Customer must send an email to the address on the Contact page of the Site to learn about the general terms and conditions of sale that apply.

 

ARTICLE 3 – RESERVATIONS

 

3.1 Reservation process for individual bookings of up to one month

The Reservation is made on the Site in the following way:

 

The Customer fills in the dates of his stay and the number of people who will accompany him, as well as the desired location of the Accommodation, then selects the Accommodation of his choice and clicks on "Make reservation".

 

The Customer is directed to a third-party page with a summary of the characteristics of the stay (dates, number of nights, maximum number of people) and a detailed quote.

 

The Customer fills in the online form with all mandatory personal data. This information is necessary to make the Reservation. In particular, the Customer must be at least 18 years old at the time of the Reservation. It is the Customer's responsibility to complete all requested information on the online reservation form and to check all information to ensure that it is correct.

 

The Customer enters his credit card details, accepts the GTC and Privacy Policy and clicks "Pay". For Flexible Rate Reservations, the amount indicated in the Reservation Summary, which corresponds to a prepayment, will be immediately debited from the Customer's credit card. The balance to be paid must be paid on the due date indicated in the Reservation confirmation email. For Non-Flexible Rate Reservations, the full amount stated in the Summary of the Reservation will be immediately debited from the Customer's credit card and will be considered as an advance. If the name of the cardholder is not that of one of the staying Customers, the person making the Reservation must complete a debit authorization form and include a copy of their ID, as well as a copy of the credit card used for payment.

 

Once Lux Living has received the amount due for the stay, the Customer will receive a confirmation email summarizing all the features of the Reservation, together with an invoice. A Reservation is deemed to have been accepted upon receipt of this confirmation email, and as long as a Reservation has not been confirmed, the relevant Accommodation may be reassigned to another Client. For each Reservation made via a Reservation platform, the working methods and conditions of the Reservation platform apply, which the Customer must take note of.

 

3.2 Reservation process for individual bookings of more than 28 nights

For a stay of more than one month, for which Lux Living must give explicit permission, a seasonal rental contract can be concluded between Lux Living and the Customer. The Customer must provide the following documents in advance: the three most recent pay slips and/or the latest tax certificate, an up-to-date proof of address, bank account details, a copy of a valid proof of identity and a bank guarantee in the form of a credit card number in the name of the Customer valid until the end of the stay plus 10 days. A Reservation or its extension will not be confirmed unless and until all such documents are provided at the time of signing the seasonal rental contract. In addition, Lux Living will inform the Customer of the amount of the deposit that will be charged to him in the event of a stay of more than one month. Under no circumstances can a Client make an Accommodation his/her primary residence for any reason whatsoever and the Client undertakes to have his/her own primary residence during the entire rental period.

 

3.3 Agreements on subsequent communication - Digital key

About ten days before arrival at the Accommodation, the Customer will receive an e-mail to verify the e-mail address he/she has provided. If the reservation is made less than 10 days before arrival at the Apartment, the pre-check email will be sent at the time of the Reservation. In all cases, this pre-checking email contains: a summary of the information related to his/her stay a link where he/she must enter certain information essential for his/her stay. In this context, Lux Living reserves the right to verify the age of the Customer, in particular by verifying the proof of identity provided by the Customer. If the Client fails to provide the requested information, he/she will not be able to access the Accommodation on the date of the start of the stay or the requested extras will not be provided, such as in particular a request for a cot.

Approximately 24 hours before the date of stay and provided that the requested pre-checking information has been provided, the Client will receive an email to the email address provided by him, containing: the exact address of the Accommodation, a description of how to access the Accommodation, the code of the Accommodation and of the entrance to the apartment complex (if secured by a code), the contact details of the Lux Living team in case of emergency.

 

3.4. Reception of Customers who do not have the Belgian nationality

In Belgium, in accordance with the provisions of the Code of Entry and Residence of Foreigners and Asylum Law (CESEDA), all non-Belgian Clients, including European Union nationals, must complete and sign an individual police form. However, this can be pre-populated by Lux Living based on the information provided by the Client at the time of Booking the apartment. This form will be kept for a period of 6 months and can be sent to the police upon request. The refusal to complete or sign such a form is considered a legitimate reason for refusal of access to the apartment. Valid ID must be presented upon arrival by any resident over the age of 15.

 

ARTICLE 4 – RATES

 

4.1 Accommodation Service

The basic rate displayed on the Site or on the booking platform is per Accommodation and per night and includes, in addition to the rental of the Accommodation, costs (water, electricity, heating, internet access via Wi-Fi and television, bed linen and towels), reservation fees and VAT in accordance with applicable law. A toilet set is also available free of charge in the Accommodation. The base rate varies based on the date of reservation, the start date of the stay, the length of the stay, the type of accommodation (number of rooms), the number of people staying in the accommodation (within the maximum allowed per accommodation), the location of the accommodation and the chosen cancellation policy (Flexible or Non-Flexible).

All reservations, regardless of their origin, must be paid in euros and include all taxes, with the exception of the tourist tax ("accommodation tax") which is dealt with in point 4.4. In the event of a difference between the number of persons indicated in the Booking and the number of persons on the day of arrival, a flat-rate supplement of thirty euros excluding tax (€30 excluding tax) per additional person per night may be applied upon arrival, up to the maximum capacity of the Accommodation. Unless expressly stated, the additional services and benefits are not included in the price of the Accommodation.

 

4.2 Household

The Basic Rate also includes: cleaning, including cleaning and tidying of the Accommodation, including making the bed(s), every third night: change of bed linen and towels, cleaning at the end of the stay. The Basic Rate does not include additional cleaning services that are charged extra, such as in particular deep cleaning that is necessary given the condition of the Accommodation after the Client's departure.

 

4.3 Additional services 

Unless expressly included in the Reservation, additional services will be invoiced additionally, viz

- Driver: Lux Living can, at your request, put you in touch with an external service provider responsible for the transport of persons,

 

- Concierge service, adapted to the wishes of the Client. The Customer acknowledges and agrees that the concierge service acts to fulfill the Customer's requests;

 

- Early check-in, late check-out (early arrival, late departure): these services offered by Lux Living and detailed in article 8 are not included in the Base Price.

 

4.4 Tourist tax

The tourist tax ("accommodation tax") is not included in the basic rate. The amount is determined per person per day and varies according to local regulations. If this tax is not explicitly stated as paid in the payment statement at the time of the Reservation, it will have to be paid by the Customer at a later date. To this end, it will be charged by Lux Living at the end of the Customer's stay by debiting the credit card number provided at the time of the Reservation. For any reservation made through a Reservation Platform, the process of collecting the tourist tax by the Reservation Platform will apply.

4.5 Baby Policy

Children under two (2) years old can stay for free if indicated at the time of the Reservation. A baby cot and a high chair can be provided to the Customer free of charge, subject to prior request to the Lux Living team upon receipt of the pre-checking email, and subject to availability.

4.6 Price changes 

Lux Living reserves the right to change prices in case of changes in laws and/or regulations that lead to a price change (in particular, changes in existing taxes or new taxes). Any change or creation of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the invoice date.

 

ARTICLE 5 – PAYMENT

 

5.1 Payment Period

For Reservations made on the basis of a Cancellation Rate, Lux Living charges a deposit equal to 50% of the total of the Reservation. The remaining amount will be debited 5 days before the start of the stay in the Accommodation. For Reservations made on the basis of a Non-refundable rate, Lux Living will charge, in the form of a deposit, an amount equal to 100% of the total amount due for the Reservation.

 

5.2 Payment Methods

Payment is made securely online through a third-party payment processor. All Reservations must be validated with a valid credit card number for the duration of the stay. The Website accepts the following payment methods: credit card (Mastercard, Visa, AMEX), for all Accommodation. Payment by bank transfer can be made with the prior agreement of Lux Living. For a payment on the website of a Booking platform: refer to the possible payment methods on the said website. All payments are made online, and Lux Living does not accept payment on site, nor payment by cash or bank draft or holiday check or any other means than specified above. Lux Living reserves the right to cancel the Reservation in case of fraudulent, illegal, incomplete or otherwise abnormal payment. At the time of online pre-checking and possibly at the time of arrival at the Accommodation, the credit card used for the Reservation and a valid proof of identity in the same name as the credit card may be requested. Otherwise, Lux Living may refuse access to the Accommodation.

 

5.3 Late Payments

In the event of non-compliance with the above-mentioned payment terms, Lux Living may charge late payment interest. Late payment interest will be due from the day after the due date of the invoice at the rate of three times the legal interest rate applicable on the due date of the invoice, applied to the total amount of the outstanding invoice including VAT.

 

ARTICLE 6 - GUARANTEE

 

A security deposit of at least one thousand five hundred euros (€1,500) will be blocked on the credit card used for the reservation, regardless of the length of the stay, provided it is less than 28 nights. The actual amount of the deposit varies per Accommodation and is determined in the description of the Accommodation on the Website. For stays of more than one month: Lux Living will inform the Customer of the amount of the deposit when sending the seasonal rental contract. Lux Living will block an amount equivalent to a refundable security deposit on the Customer's credit card to verify that he/she has sufficient funds. This amount, which may vary according to the accommodation, the type of accommodation and the length of the stay, will only be deducted in case of material damage caused during the stay after deduction of non-paid services, including optional services, and other costs incurred. If the Client refuses to pay the deposit or if his/her credit card does not allow sufficient funds to be blocked, Lux Living cannot guarantee access to the Apartment.

A joint inventory of the furnishings can be drawn up between Lux Living and the Customer upon arrival and departure. However, this inventory is not carried out systematically upon arrival and/or departure due to the autonomous character of arrival and departure. Lux Living therefore advises the Customer to check upon arrival whether the Accommodation is in good condition and to immediately report any damage to Lux Living, failing which the damage may be charged to the Customer. A description of the Accommodation including a list of equipment will be made available to the Client in the Accommodation, it is the responsibility of the Client to check that all items listed are present in the Accommodation and, if not, to notify Lux Living without delay of any missing item. The Client undertakes to return the Apartment in the same condition in which he found it.

 

The Client is responsible for any damage, loss or breakage of objects, utensils or furniture in the Accommodation, except if these are due to normal wear and tear or force majeure. If no property damage is found within 48 hours of departure, the security deposit will be released in full within a maximum of 7 days, although the bank may require a few additional days to process the refund. If, for any reason, Lux Living is unable to check the condition of the accommodation at the time of departure, the deposit may be retained for a maximum of 7 days. In case of damage, the deposit will be refunded minus: the fees withheld for repairing damage caused by the occupants (i.e. any damage and/or disturbance of any kind in the private areas or in the common areas of the Accommodation or of the building in which the Accommodation is located), unpaid services including optional services consumed on site, required deep cleaning. If the amount of the deposit is not sufficient to cover all costs, Lux Living reserves the right to take any action, including legal action, against the Customer to claim compensation for the entire loss.

 

ARTICLE 7 - CANCEL OR MODIFY A RESERVATION

 

7.1 Conditions for complete cancellation of the Reservation

For Reservations made on the basis of a Flexible Rate: Cancellation is free of charge if the Customer cancels the Reservation up to five (13) days 24 hours before the commencement date of the stay. The amounts paid on the Reservation will therefore be refunded in full within 48 hours of receipt of the cancellation, subject to bank delays. After this period, Lux Living will charge a cancellation fee equal to the total amount of the Reservation and will therefore not refund the amount paid as a deposit for the Reservation.

For Reservations made on a Non-Flexible basis, Lux Living will charge a cancellation fee in the amount of the full amount of the Reservation and Lux Living will therefore not refund the amount paid as a deposit for the Reservation. For the additional services chosen at the time of booking, Lux Living does not accept cancellations after the above deadlines. The amount of the reserved additional services remains due in full.

7.2 Conditions for changing the reservation

Any change to the date, length of stay or chosen accommodation for the reservation initially confirmed by Lux Living is considered a full cancellation and is subject to the conditions of Article 7.1 above. However, for Reservations made on the basis of Cancellation Only, Lux Living may, at its sole discretion, subject to availability and without any obligation to stay in the same Accommodation or at the same price, allow the Customer to partially change the Reservation, except for the start date of the stay if it has already passed at the time of the change request. In this case, the partial change will be authorized in writing and the following conditions will apply: If the partial cancellation of the Reservation corresponds to a change in the duration of the stay, this will probably lead to a change in the rate. If the length of stay is shorter than the originally booked length of stay, the rate change is retroactive to the day of arrival. In the event of an extension of the length of stay, the rate change will be applied from the date of the announcement of the extension of the stay for the additional night(s). The rate change will not be applied retroactively.

 

7.3 Notification

To be taken into account, any change (full or partial cancellation - extension - change) must be communicated directly to Lux Living by email with acknowledgment of receipt or by registered letter with acknowledgment of receipt.

7.4 No Show

If the Customer does not show up on the day of arrival, for whatever reason, Lux Living will not issue a refund.

 

ARTICLE 8 - ENTRY IN THE APARTMENT - ARRIVAL AND DEPARTURE TIMES

 

The Client enters the Accommodation using the codes sent to him by e-mail, which he must enter on the keypad of the Accommodation and, if applicable, on the keypad of the entrance that gives access to the apartment complex. The keypad code of the Accommodation is active for the duration of the Client's stay and is changed as soon as the Client leaves. The Client is entitled to access the Accommodation from 3:00 pm (local time) on the day of commencement of the stay and undertakes to vacate the Accommodation no later than 11:00 am (local time) on the day of departure. Subject to prior approval and payment of the additional costs, it is possible that the Customer arrives earlier and/or leaves later. In the case of an early arrival (from 10 am) or a late departure (until 4 pm), a surcharge of € 150 per early arrival and/or late departure will be charged. Outside these times, an additional night will be charged at the rate applicable on that date. If the Customer does not explicitly request this, and if the Customer has not left the Accommodation after 11:00 am on the day of departure without being authorized to do so, Lux Living reserves the right to charge an extra night at the rate applicable on that date. In the event of a conflict with another reservation commencing on the same day, Lux Living is obliged to vacate the Accommodation with all legal remedies available to it and to claim compensation for all damages.

 

ARTICLE 9 - RESIDENCE POLICY

 

The Customer undertakes to take note of all rules and instructions drawn up by Lux Living regarding the use of the accommodation and equipment, as well as to read and comply with the House Rules of the accommodation which will be sent to the Customer during the pre-checking email. Lux Living cannot be held liable for any violation of the above rules and regulations. In addition, the Customer must comply with the following provisions:

Occupancy Rate: Unless expressly authorized in writing, the Customer is not permitted to accommodate additional persons not foreseen at the time of the Reservation. Any non-compliance with this may lead to an adjustment of the price of the Accommodation. In addition, in the event of non-compliance with the maximum occupancy rate of the Accommodation as indicated on the Website, Lux Living reserves the right to refuse access to all or part of the excess persons or even to terminate the Reservation immediately and without any possible refund for the Customer's fault. In this regard, it is specified that all children from 2 years old are considered full-fledged residents. Lux Living informs you that it is not possible to install extra beds in the Accommodation (however, it is possible to add a cot for a baby upon request and subject to availability).

Nuisance and respect for the neighborhood: The Client undertakes to respect the other residents and occupants of the building in which the Accommodation is located and the tranquility of the premises and to avoid any kind of nuisance, in particular noise or smell. In case of untimely noise or inappropriate behavior, the Client will be asked to leave the accommodation immediately, without refund, Lux Living reserves the right to claim damages in case of damage to the common areas or complaints from other occupants of the building.

Sound level recording device: the Client is informed that a sound level recording device is installed in each accommodation. This device alerts the service provider appointed by Lux Living if the threshold of 70 decibels is exceeded. In this case, if the recorded noise level in the Accommodation exceeds the set level, the Customer will receive a message on the telephone number provided that the noise level is too high and that the noise level in the Accommodation must be reduced. Lux Living will be notified at the same time. If the sound persists, a 2nd message will be sent. On the 3rd warning, the service provider designated by Lux Living will go to the accommodation to physically warn the Client that the noise level in the accommodation exceeds the threshold of 70 decibels. The costs of this visit can be invoiced to the Customer. In this case, Lux Living reserves the right to terminate the Reservation immediately, to ask the Client to leave the Accommodation immediately without refund and to claim compensation in the event of damage.

Use of the Accommodation: The Accommodation is reserved for personal residential use, with the exception of telecommuting, if permitted to the Client and rentals planned for professional events for which Lux Living has been informed and agreed. It is strictly forbidden to organize parties or other events inside or outside the property. Prostitution and the practice of prostitution are strictly prohibited, as is any trade or use of drugs. The Customer undertakes to keep the movable property made available to him in the Accommodation in good general condition and will report any defect or defect to Lux Living by e-mail as soon as he becomes aware of it. In addition, the Client is reminded to close the accesses to the Accommodation (bay window, window(s), common lock, building door and entrance door) when leaving the premises.

Liability: The Client undertakes to return the Accommodation in perfect condition and will be held liable for any damage, loss or theft of objects or equipment.

Minors: Lux Living Apartments cannot accommodate minors under the age of 18 who are not accompanied by their legal representatives. Consequently, Lux Living may request any documentary evidence to verify the correct application of this provision. In the event of a breach of this provision, Lux Living may, at its sole discretion, cancel the Reservation or immediately terminate the stay.

 

Smoking: Smoking is not allowed in the Accommodation. Any evidence or lingering smell of tobacco may result in additional cleaning fees and compensation for nights not allocated to other Clients.

 

Pets: Unless explicitly stated otherwise in the description of the Accommodation, pets are not allowed, with the exception of assistance dogs and guide dogs, which are accepted free of charge under the following conditions:

- That the Customer has indicated the presence of his dog when completing the pre-checking information;

- that the dog does not cause any smell, noise or other nuisance;

- that the dog does not disturb people's peace and safety, the Client undertakes to respect the basic rules of hygiene and the integrity of the Accommodation, both in the common areas and in the Accommodation itself, and to keep the dog on a leash in the common areas, whereby the Client is also responsible for any damage caused by the dog;

- That it is up to date with its vaccinations and in particular that it has been vaccinated against rabies, Lux Living is able to request the rabies certificate.

 

Wi-Fi: The apartments offer free Wi-Fi access allowing Clients to connect to the internet. The Customer undertakes to ensure that the computer resources made available by Lux Living are not used in any way for the purposes of reproduction, representation, delivery or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the consent of the holders of the rights provided for in Books I and II of the Intellectual Property.

 

Property Act, where this permission is required. The Client must comply with the security policy of the Internet provider of the Accommodation, including the rules for using the security measures implemented to prevent the illegal use of IT resources [or any other term used in the IT charter of the company], and refrain from any action that undermines the effectiveness of these measures. If the Customer fails to comply with the above obligations, he risks being sued for counterfeiting (article L.335-3 of the Code de la Propriété Intellectuelle), which is punishable by a fine of 300,000 euros and three years in prison. Likewise, the Customer shall refrain from using the internet resources made available to commit an act punishable by law. In any case, Lux Living cannot be held responsible for any malfunctions, total or partial unavailability of Wi-Fi.

 

Access to the Accommodation: The Customer agrees that Lux Living or its service providers may access the Accommodation to carry out cleaning and/or urgent maintenance or repair work and/or to enforce safety or nuisance prevention requirements.

Smoke detector: for obvious safety reasons, a smoke detector is present in every accommodation. If the detector is activated by an action of the Customer, Lux Living can charge all costs incurred, in particular in the event of intervention by the fire brigade and/or police.

 

Photos: The Client may photograph the Accommodation for its own personal use, but it is not permitted to market or publish these photos in any medium whatsoever.

 

Returning the Accommodation: the Customer undertakes to leave the Accommodation clean, undamaged and in good condition upon departure.

 

If the Customer is guilty of activities or behavior that are contrary to the GTC or the House Rules of the Accommodation, or in case of behavior that is contrary to public morality and order, Lux Living may be obliged to cancel the Reservation immediately and without notice and without compensation and to request the Customer to leave the Accommodation immediately and without reimbursement, Lux Living reserving the right to claim additional compensation in the event of damage, to file a complaint or to report it to the competent authorities. If payment has not yet been made, or in case of partial payment, the Customer must pay the price of the nights booked and the services ordered before leaving the Accommodation.

 

ARTICLE 10 - DESCRIPTION OF THE ACCOMMODATION

The Accommodation and services correspond to those presented on the Site or the Booking Platform. However, the descriptions and photos presented on the Site and/or the associated Booking Platforms, as well as the services presented, are given for information only and are not contractual. While every effort is made to ensure that the photographs, images and text used to illustrate the Accommodation presented are as accurate as possible to the Accommodation offered, variations may occur, particularly due to changes in furnishings or renovations. The Customer cannot claim compensation for this.

ARTICLE 11 - LIABILITY - EXCLUSION OF LIABILITY

 

The Client and/or the resident acknowledges that he cannot rely on the legal provisions applicable to residential rental agreements, in particular with regard to the maintenance of the home. The occupant undertakes not to elect domicile at the address of the Accommodation, neither for tax purposes nor for professional purposes, nor to lend, sub-let the Accommodation, for any reason whatsoever, or to grant its use to a third party free of charge.

 

Lux Living cannot be held liable for damage, theft or behavior of which the Customer could be the perpetrator or victim. Lux Living cannot be held liable for loss, theft or damage to personal belongings in the accommodation or in the common areas. Likewise, Lux Living does not guarantee constant and uninterrupted access to the Website, nor a working internet connection and optimal throughput at all times within the Accommodation. Lux Living accepts no liability for damage resulting from misuse of the internet by the Customer, such as viruses or spam.

 

Lux Living cannot be held responsible or held liable for any damages or compensation in the event of delay or non-performance of its contractual obligations due to force majeure. In the event of an exceptional event or the impossibility of making the reserved accommodation available to the Customer or in case of force majeure, Lux Living may offer the Customer another accommodation, for part or all of the stay, in an equivalent category, for services of the same nature and subject to the prior consent of the Customer.

In case of request for the Concierge Service, Lux Living cannot be held responsible for the performance, incorrect performance or non-performance of the services or the conformity of the goods requested by the Customer to the Concierge Service and performed by third parties. In the event of a claim of any kind, the Customer must contact the affected partners directly. In no event shall Lux Living's liability exceed the amount of the service or property to which the damage relates.

ARTICLE 12 - INTELLECTUAL PROPERTY RIGHTS

The entire Website and its contents (including, without limitation, all texts, images, photographs, logos, drawings, etc.) are the exclusive property of Lux Living. Accordingly, the Customer may not reproduce, exploit, copy, publish, market, promote, distribute, license, sell or otherwise use the content published on the Website without the express prior written consent of Lux Living, which may be subject to financial consideration.

ARTICLE 13 - INTERPRETATION PRINCIPLES

These T&C are supplemented by the Legal Notice, Privacy Policy and Cookie Usage Policy. As these documents may evolve over time, the most recent version prevails over previous versions. These contractual documents apply to the exclusion of any other document issued by the Client which is not enforceable against Lux Living. These documents set out the full obligations of the parties with respect to the subject matter they cover. No general or specific terms and conditions communicated by the Customer can be incorporated into these GTC. The contractual documents constituting the commitment of the Parties are, in descending order of priority, the confirmation of the Reservation, the Rules and Regulations of the Accommodation, the GTC, the Personal Data Policy, the legal notices, the policy on the use of cookies. In the event of any contradiction between the booking confirmation and the GTC, only the provisions of the booking confirmation shall apply to the relevant obligation. In the event of any difficulty of interpretation between any of the headings at the top of the clauses of these GTC and any of the clauses, the headings shall be disregarded and the content of the relevant clause shall prevail.

ARTICLE 14 - COMPLAINTS - DISPUTE RESOLUTION

 

The Lux Living team is at the Customer's disposal during his/her stay to answer their complaints, resolve any malfunctions and enable them to fully enjoy their stay. Please contact your local agent. Any complaint, after the Customer's stay, regarding the website www.luxliving.be, our accommodation, our services or any provision of the GTC or of our Personal Data Policy or our Cookie Policy, must be made, within three months of the departure date, either by a letter sent by registered mail with return receipt to Lux Living - Customer Service - Veurnestraat 28 8660 De Panne, Belgium or by an email from your agent. Any complaint must contain the following information: the reservation number, the place and dates of the stay, the type of accommodation booked, the reason for the complaint and any supporting documents that may be helpful in handling the request.

 

In the event of a dispute, the two parties undertake to try to reach an amicable settlement before taking legal action. Failing this, either party may take legal action. As a reminder, requests for an amicable settlement do not suspend the deadlines for starting legal proceedings. If the dispute cannot be settled amicably with the Customer Service Department, and provided that the written complaint was submitted less than 12 months ago, a mediation procedure may be initiated by referring the Government.
